DAMN Chris! I'm so sorry and I understand a portion of your pain and frustration with how we got fucked by lazy judges and courts regarding my dad's probate and the forged will presented by his widow (the BITCH!).

Damn, just damn. Is there no "local" appeal process, short of contacting the Arizona Bar Association, to force the administrative judge to actually do his/her job? What you and Mel are going through proves that there is no justice in our justice system.

Now you know why I keep mentioning that “The Bard” and Mark Twain both said, "The first thing we should do is kill all the lawyers." They say that politicians are just failed lawyers which in many cases is true but you know what a judge is? Someone you can’t hire, just bribe!

Judges, congressmen and senators all step all over the laws because they know we mortals are too scared to prosecute them...I remember a case in the 1970s in Ariz, I believe, where a judge had been nabbed and brought to court for a DUI...I think the arresting officer, a newbie, is still cleaning toilets but the next weekend the same POS judge, drunk as a skunk, kills two pedestrians (on the sidewalk) after jumping the curb and smashing into a storefront...He would get looped nearly every night of the week and drive home and the cops just looked the other way because they feared for their jobs or the treatment they would get by him or other members of the judicial clique od fuckstains...

Can you not file that the judge did not have basis to decide the case as he was only a temp and it would be better to wait for the previous judge?

What about visitation rights? Will the MFKR take the kids for holidays and such and if so at his expense? Children under 12 yrs of age, according to IATA rulings cannot travel alone on a trip involving connecting/change of planes flights--they must be accompanied! They are considered "unaccompanied minors" and have to be met at both ends by the people on the airline's declaration form when on a non-stop flight...I don't know of any non-stop flights between Toronto (YYZ) or Montreal (YUL) and Phoenix (PHX)...Will he pay for you, Mel or a nanny/body guard to travel both ways or will he fly in both directions with them?

Is there a chance that he would retain the kids in Canada without your say so (I didn't want to say kidnap as it really isn't but it is, which makes no sense what-so-ever?)

From what you've written he wants nothing to do with the kids so why the big bullshit antics? Is he paying alimony and/or child support? If yes, I would think he would be glad to stop paying?

I'm sorry for your bad news, and I hope your attorney will see a way to put things right.

In the meantime, and once the initial shock wears off, you might consider moderating the tone of the OP. Your opponent is bound to read it, and will (a) delight in your frustration and (b) miss no opportunity to show it to any and all judges who might still come into play, by way of demonstrating your contempt for judges and the legal system. No matter how justified your anger, giving it public expression at this stage surely won't help your cause.

My experience is that family court judges are all touchy feely, afraid to take decisive action.
The only good thing about this is the father is using up all his inheritance to keep this case going. Sad when a man can't move on, eats him up it will.
Any thoughts on a letter writing campaign to the local paper? Or some other campaign to get the ass. Just to get the opinion out on this judge.

As a law school student, and someone who is going to be a lawyer (hopefully) within the next year and a half, I am appalled and ashamed when I hear things like this. It casts doubt on the legitimacy of the entire legal system.
I mean, what kind of irresponsible ass-hole can do this while sitting on the bench?

I'm so sorry to hear about this Chris. This judge is a disgrace, and what's been done to you is an injustice.

You may want to consider filing a grievance with the Arizona Bar Disciplinary Council/Statewide grievance committee (not sure what they call it down there). They may not do much, but if they review it and find that he has violated the rules of professional conduct he be reprimanded or even suspended should his actions be considered grievous enough.
