DC Metro - Sie Papieren Bitte!

Post by D5CAV »

DC Metro police will now be conducting random searches of passengers. http://www.wmata.com/about/met_news/Pre ... aseID=2324

I guess they've stopped showing those old B&W propaganda movies from the 1940s where the GeStaPo (State Security Police) go up to Humphrey Bogart and ask "Your papers please, mein Herr!" -- that would be way too close to home!

Whenever business takes me to downtown DC (which I avoid unless absolutely necessary), I park my car in Springfield and take the Metro in. That way, I can leave my 'stuff' in my car.

To those members of this forum who are LEO. I'm sorry it has come to this, but it is time to push back: http://www.flexyourrights.org/subway

Worst case, I take a taxi.

This is the point where an honorable American serving as a law enforcement officer starts looking for a new line of work or a new agency to work for.

The tools of the state that are currently working feel that they have a shiny new toy to be used in pursuit of "justice".

What a bunch of utter crap:
Security is a top priority at Metro. We’re committed to enhancing the safety of our riders and employees and security inspections are an important part of that effort,” said Metro General Manager John Catoe. “It’s important to know that we have received no threat to the Metro system, but we have the responsibility to do everything we can to keep it safe."
If that was truly the case, they'd check under jackets for suicide vests or other items that could be taken off and left behind and either timed, mercury-switched, or even radio/pager/cell phone activated.

It's like the airlines, it's to make the mass population FEEL safe.

I may be mistaken, won't be the first time but the article says this:
Shut Your Mouth and Your Wallet
You do not have to answer any police questions or give any information -- including your name, ID citizenship or immigration status -- whether or not you consent to a search. But remember, anything you say can be used against you.
I thought you were required to identify yourself to police at a minimum. I can see this leading to other problems, no matter how polite you are.

Yeah, they do this in NYFC, which is where it was started and you can see, it's spreading.

If you refuse the consent search, they deny you permission to board the public transportation - so you're not under arrest unless they can find some other reason to detain and search you. You just can't get on the transportation (or go into the subway, bus or train station, etc.).

Once arrested, you have to ID yourself -- that is all you can be required to say. I'm unsure if you can be required to ID yourself w.o. being arrested. I suspect you are free to refuse, unless the patriot act attempted to change things -- I could see freedom of association, and the "right to privacy" being implicated.

Already signed, sealed and delivered by the 'Supremes'. You have no such right. You must ID yourself if requested by the GeStaPo or anyone else who produces some badge of authority. http://www.papersplease.org/hiibel/

from your link...

Deputy Lee Dove of the Humboldt County Sheriff's Department came on the scene - siren a-wailing - in response to a domestic violence report. Someone saw Mimi arguing with her dad and thought it had come to blows. The witness said that he saw "a man with a black cowboy hat" who "slugged the female". Dove was there to investigate the report.
cop is investigating a potential domestic violence case... he is perfectly legal in asking for ID...

the SCOTUS agreed:

One thing you can do before-hand is get all of the officer's information.

What is your name? Badge number? What authority to you represent (e.g. State Troopers or Subway police)? Etc...

Unless you are prepared to spend the dollars and the trouble that follow, don't "represent".

The best course of action is to be respectful and courteous and demand it in return.
