News 96.5 - Orlando; Port St. Lucie, Fla. —

A 19-year-old Florida woman has been arrested, accused of squirting her boyfriend with a water pistol.

Giovanna Borge is charged "for squirting water on (her boyfriend) to antagonize and agitate him against his wishes."

According to a recently released arrest warrant, Borge was arrested on Sept. 27 following an escalating incident between Borge and her boyfriend.

Police were called their apartment in response to domestic violence.

It's not likely the arresting officer had ever written a report quite like this one:

I spoke first to the female half, Giovanna Borge, who was outside the apartment. She was in an upset/excited state, and was experiencing rapid shallow breathing. Giovanna was able to tell me that her boyfriend of about a year, (boyfriend) said something to her she did not like. Giovanna then took a water pistol and squirted him with water. (boyfriend) then responded by dumping a container of water on her. She continued that he then hit her with a pillow and there was mutual shoving with her ending up in the tub in the bathroom. Giovanna had no visible injuries but stated she has been injured in domestics by (boyfriend) in the past which were unreported to Law Enforcement.

• I spoke to (boyfriend) who said that he was in his room when Giovanna came in and started screaming at him, then squirted him with a water pistol. He then poured water on her and also corroborated the mutual shoving. (boyfriend) was not injured.
  
  I spoke also to the three witnesses who did not see the altercation, but heard it as they were all in the apartment. (Witness) and (witness) were all consistent in that (boyfriend) was quiet in the bedroom. They thought he was asleep but he was actually playing Xbox quietly. They all agreed that unprovoked, Giovanna started screaming at him. They then heard scuffling and banging noises. They all heard (boyfriend) yelling “get off me, get off of me” which led them to believe Giovanna was aggressing on.
  
  Based upon statements from both suspect and victim, and the three witnesses, investigation revealed that Giovanna was the PRIMARY AGGRESSOR in the incident today.
  
  I request a UCI responded to take photographs. Ofc. C. Durbin responded to photograph. Also, Giovanna was continuing to have difficulty breathing and appeared to be worsening. I requested Rescue and provided Giovanna with a paper bag to breathe into to help stabilize her hyperventilation. Rescue responded, attended to Giovanna who refused transport, and departed.
  
  I placed Giovanna under arrest for Simple Battery/Domestic Violence under F.S. 784.03 for squirting water on (boyfriend) to antagonize and agitate him against his wishes. I handcuffed Giovanna in front to make it easier for her to breathe, checked for fit, and double-locked the handcuffs. I transported her to St Lucie Co Jail without incident.

Her boyfriend is a puss, the arresting cop is and under-educated or under-trained jackhole, and any government legal counsel charged with prosecuting the "crime" who elects to prosecute should be laughed out of town by the jury.

I think if she goes for a jury trial, she not only walks, but the jury finds the prosecution guilty of criminal stupidity and professional misconduct, and hopefully the judge in any such proceeding will throw the case so far out of court on presentation it bounces off a lightpole, and then gives the State a serious in-chambers ass-chewing for wasting the court's time.
I'd stop short of contempt, but should just make counsel play hopscotch in a duncecap and bermuda shorts in front of the court an hour a day at lunchtime for 30 working days before allowing them in his courtroom again.

Otherwise, I think FL can look forward to making squirt pistol sales 4473 reportable.

Am I reading this wrong? She wasn't arrested for actually using a squirt-gun, but for spraying water on her boyfriend and screaming, thus initiating a physical fight. The result would have been the same if she had had the water in a glass and tossed it on him. Basically the cops showed up for a DV call and arrested the initiator. She wasn't arrested for anything gun related, or even anything weapons related, but for being the aggressor in a domestic violence incident.

It could also be a case of her becoming crazy from the sticker being lazy.

A lot of DV results from economic stress; I don't have any idea if X-Box boy has a job as a Wall Street Broker or a Wal-Mart stocker, but I've seen couples come off the rails many times because the guy didn't make any effort to make a living. Just sayin'.

There are those people who like drama in their lives, and when I was working patrol, there were those people who habitually called the police over trivial bullshit. Sometimes after three or four calls it's easier to arrest someone for DP/Aggravated Ignorance/Impersonating a Human Being, and reminding them on the way to the station that all this could have been avoided.

Some people have no clue.
In most states the law is that the police must take action in Domestic Violence cases.
I arrested a juvenile (male) for throwing orange juice on a girl at the school bus stop a few years ago.

I went to the school and arrested the boy in the classroom. He was one of the little street thugs in my area. He also did not live in the school district. I turned him over to his grand mother with a custodial Agreement charged with simple battery. He was moved to the school where he lived. Found guilty in juvenile court and put on probation.
