A lot for the courts to unpack there. Not going to even try to predict any outcome because Texas.

Edit to add; the shootee gives the impression of being a big dude who is used to being able to get his way due to size and intimidation. He may or may not have been in the right on the custody issue, but that's not really relevant once you refuse to leave a property and try to grab the resident's gun.

First, some one has to say it: Don't mess with guys named Kyle. Kyle f* you up.
Agree de-escalation on either side would have been a good thing, at least until the cops showed up to escort the shootee off the property.

Given the size discrepancy between the two men that's bullshit on the face of it. Especially when the bigger guy advances (twice) to move to contact with the smaller man, even after he's armed himself.

Whatever the courts decide, Chad continuing to escalate to physical contact after the owner armed himself instead of backing off the property and calling the cops makes him a contender for the Darwin Award.
...even before I read MHI, my response to seeing a poster for the stars of the latest Twilight movies was "I see 2 targets and a collaborator".

I saw the video, the dead guy didn't even raise his hands up until after boyfriend went and got a gun. What I think is that ex-wife had boyfriend primed and ready with tales of how mean dead guy was to be her white knight. I think boyfriend is going to jail and having his finances destroyed. But the real murderer, the ex-wife who deliberately screwed with the custody and set the whole thing up to piss dead guy off (probably far from the first time either)... she as good as pulled the trigger on him but she will never be charged with a crime.

The tales of how mean dead guy was probably weren't too much of a stretch, given that we've seen how he behaved when he KNEW he was on camera.

I am with Randy here... I think the only things that are going to matter here are that he was told to leave and didn't, and he made a grab for the weapon. Plus maybe the fact that this took place in Texas.

At least the custody thing appears to be settled.

Yeah, the courts have a lot to unpack. Shooter's wife (they appear to be separated) is a judge who recused herself from the case of her husband shooting his girlfriend's ex-husband. Local DA's office recused itself "on the grounds that an elected official may be called to testify." Yet another judge has recused himself from the wrongful death suit because he originally heard their divorce case.

And finally, I guess the custody issue isn't settled because the dead guy's widow is suing to take custody of his children away from their mother. Seems like a stretch given she's not the one who did the shooting, but damn.

A few random observations.

The ex husband appeared to be acting like an a-hole but not actually violent. Boyfriend- why not call the police and standby just inside the door until they got there (in case things went sideways before they got there).

Ex-wife - go inside and close the door. If if he forces his way in then shooting him is an easy call.

Ex-husband, if you are at someone else's house and they have a gun and tell you to leave, then leave. The cops and courts can sort that out.

Ex-husband, if you go for someone's gun, you better get the gun or they will most likely shoot you.

The video does not show the Ex-husband after the Boyfriend pulls away and shoots him, what he is doing then is likely going to make or break a self defense claim. If he is coming at the Boyfriend then self defense seems strong, just standing there or raising hands then Boyfriend is likely in deep sh**.

+1 to Johnnyreb and Vonz's last. Except, there's another video here from another angle. Ex-husband appears to be just standing there when he's shot. Not coming at the boyfriend.

In addition to Johnny's speculation, I speculate that boyfriend has an inflated sense of his own invincibility from his connections. Look at how he talks to the woman in the truck taking the video. He doesn't seem at all worried that he just shot someone.
Note to self: start reading sig lines. They're actually quite amusing. :D
