First thought: What firearm (I assume revolver since the reporter says he fired 5 shots), and what caliber?
Second, the "victim" is the guy who charged the firearm owner. Remember what to tell the police when they come!
Third, just waving a pistol is not the magic wand of power. Criminals might not care.

I can't believe the shooter's in any trouble, unless his BAC showed he'd been drinking.
Even so, nail him for drink & carry - but from all I can see the shoot was textbook clean. He tried to retreat, tried to warn 'em off and this guy jumped him. Who WOULDN"T shoot at that point?
Best of all, all rounds apparently into target.
I'd donate to his "defense fund" in a heartbeat.
