Happens here in NC a few times a year. In NC, you are fully justified in using lethal force to stop someone from breaking into your house. They do not have to be in the house for you to shoot and shooting through the door is usually justified.Darrell wrote:That happened here in town a while back, a young drunk guy pounded on the door of the wrong house, then proceeded to break the door in. Legally justified, yes, but not necessarily in the "looking yourself in the eyes in the mirror after waking from the resulting nightmares at three in the morning" sense...mekender wrote:Happens here in NC a few times a year. I think if a man's trying to force his way in, you might be better off dealing w. him before he gets inside, and start looking for accomplices... Smashing into a home, esp. at night, indicates a desire to inflict violence, IMO.

HA! Dunno if they saw it. The porch was lit and my vantage point was not. At the short range between the upstairs window and my front porch, it would have been a clean shot with a messy aftermath.Did they see the SKS? If so, you might be able to track them by smell...
You did good. What did the cops say?
As for the Cops, they were good about it. Complimented me on not opening the door, keeping my cool in refraining from discharging a round in a residential neighborhood, etc. They took the report, said the description of the doorman matched previous reports, wished me well and left. I received a follow-up call from the responding LEO the next day. All in all, a class act.
Of course, I am a LE Academy graduate and make sure that I mention that fact in any encounters I've ever had with any LEO. That and a respectful, courteous manner USUALLY makes things flow more pleasantly for us both.
There must be an end to this intimidation by those who come to this great country, but reject its culture.

Also to clarify, if they do happen to actually enter your house, you have no "justification" to shoot them if they are "unarmed." Despite theoretically that the victim could be a little Grandma and the perp is a 200+ lb gorilla of a man possibly hopped up on drugs. So you better stop them before they get though that door/window if they mean you harm.mekender wrote:Happens here in NC a few times a year. Not sure how that scenario would hold up in court, but I'm praying NC gets a REAL castle doctrine soon. (I can't do much about it here in [strike]exile[/strike] Michigan.)

Re: My Home Invasion Experiences This Summer
But if they're breaking into YOUR home, it's not YOUR duty to check to see if they're armed or not, because by that time, it may be too late. In California no less, you have a LEGAL PRESUMPTION of fear for your life or serious bodily harm, if someone is breaking in while you're home. The suspect's size, build, gender, sexual persuasion, orientation, prayer preferences, God preferences, whether they wipe with their left or right hand, use deodorant, smell like camels, smell like pigs, eat sushi, like Samurai swords, watch American Idol and/or Survivor, pray on your knees, pray on your stomach, pray on your back with your feet in the air, all of which mean NOTHING if you break into someone's home uninvited and you don't live there (yes, you need to REASONABLY make SURE of your target before ventilating it). California law PRESUMES you have have this fear after several high profile cases of homeowners being taken to court for defending their home while home invasion robberies were on the rise.
This was BEFORE the dhimmicraps got control of the legislature. Things have gone downhill ever since. Armed or unarmed does NOT even matter - the legal presumption doesn't distinguish or even care if they packed a knife, blowgun, poisoned darts, slingshot, bb gun, or .500 S&W Magnum. In effect, California was the FIRST state to have anything even resembling the Castle Doctrine, although it's not quite as good as the Castle Doctrine, but it was the first BIG step in that direction.
I'm glad other states have taken it further since COMMIEFORNIA has been inundated with IDIOT DHIMMICRAPS (I repeat myself), so it's going to take a while before we catch up to the rest of the nation.

Armed or not does not matter. If they are in the process of breaking in, then it is a good shoot. Once they enter, they must then pose a threat to you in order for you to have a good shoot.

In CA if they're breaking in that is all you need for justification -- armed or not.
