When I had my own business, I had an employee get hurt on the job. Poisonous snake bite. I filed the paperwork, stated the facts and did what I could. The insurer denied the claim outright. My employee had a $30k medical bill and I ended up in arbitration and had to pay $3500 between my lawyer fees and my "share" of the medical bill. The insurer paid about $4000 and the hospital had to eat the rest.

My leasing company and their insurer were dirty scumbags who lied about everything under the sun and threatened me to try to not have to pay. Then canceled me. Bastards.

So it probably isn't the franchisee but some insurer or re-insurer, playing the waiting game or trying to figure out an attack strategy to screw everyone involved.

I'm firmly of the opinion that if this is SOP for insurance companies, we should be able to give them what I call "Quality of lifestyle changing" beatings.

Simply put, do the right thing, or never walk again.

Sorry, I was imprecise. I know that the individual restaurant is a franchisee (I used to write franchise agreements for another global-mega-corporation for a living...). I think this is a case where the McDonalds "mothership" should step in and see that the right thing is done. After all, the safety of McDonalds' customers and staff is an issue which affects the whole operation and its reputation, not just the individual franchisee.

There's a few hundred thousand of my neighbors who're still trying to get their claims from Katrina sorted out who'd love to get in on that action... :evil:
