Georgia: Madison County Board of Commissioners to Consider Anti-Gun Ordinance on Monday, November 24

Friday, November 21, 2008

Please Stand-Up and Make Your Voice Heard

On Monday, November 24 at 6:30 p.m. the Madison County Board of Commissioners will be discussing a proposed ordinance that would ban the discharge of a firearm in “close proximity to a residence.”

While details about this proposed ordinance are scarce, it is vital that gun owners and sportsmen of Madison County attend this hearing and make their voices heard. There is little doubt that non-shooters and anti-gun forces will be active in this public input process.

The meeting will be held in the Madison County Courthouse’s Public Meeting Room located at 91 Albany Avenue in Danielsville.

Please attend Monday’s meeting and express your opposition to this measure. If you cannot attend, please contact the members of the Madison County Board of Commissioners and respectfully urge them to oppose this proposal. Contact information can be found below.

Is this considered 'reasonable restriction' or does this violate the State's preemption law? By the way, I wrote both my State congresscritters to complain about this. Not sure what they can, or will, do about it, since it's not yet a State issue and they are both big-L Ds.

Okay, I found this on Georgiacarry.org:

Also state preemption allows local governments to pass ordinances "reasonably restricting" the discharge or shooting of firearms within the political subdivision. "Reasonably restricting" means restricting the discharge of firearms in pursuant to target practicing and hunting. This does not apply to discharging of firearms pursuant to defense of health, life, and property.

We have a somewhat similiar parish(county) ordinance here in Cenla. It says within either 100 or 200 ft(I don't recall the exact distance) of a residence other than your own. What this means, practically speaking, is that you can't practice with your 9mm/45acp in your backyard, if you live in city limits, or if your house is in an outlying subdivision. The reasoning is obvious; no one wants bullets zinging thru their backyard.

It is also one of the most ignored ordinances, and you can get away with it by exercising good discretion. I've shot quite a few feral cats, garden-raiding rabbits, squirrels, etc using a .22 rifle and subsonic or CB rounds. Or a highpowered air rifle. No one's ever complained, and I have a deputy sheriff that lives across the street from me; he reloads his own ammo..... :D

Madison County gun ordinance swiftly rejected

DANIELSVILLE -Madison County commissioners voted 4-1 Monday night not to enact an ordinance that would have prohibited residents from firing a weapon within 300 feet of a home in the unincorporated areas of the county.

At least 100 county residents, many of them wearing anti-gun-control stickers, attended the meeting to protest the ordinance. The crowd forced commissioners to move the meeting to the county's courtroom, which still did not accommodate everyone.

Commissioners would violate not only the Second Amendment, but also the rights of property owners if they approved the firearms ordinance, residents said.

Thank You for Standing-Up and Making Your Voices Heard!

On Monday, November 24 the Madison County Board of Commissioners voted 4 to 1 to defeat a proposed ordinance that would have banned the discharge of a firearm within 300 feet of a residence. If passed, this measure could have had disastrous effects on Madison County’s hunters and recreational shooters.

Because of overwhelming turnout from freedom-loving patriots, the county was forced to move the meeting to a location that could accommodate the hundreds of pro-gun attendees.

Thank you to all of the NRA members who attended Monday’s hearing or contacted the Board of Commissioners to express their opposition to the proposed measure. Without you, this victory could not have been possible.
