Even better for the defense, all three of the men he shot are felons. One pediphile, one domestic abuser, one robber (the one with the Glock). And the one with the pistol has already said freely he was trying to kill Kyle and was upset that he had not.

I have yet to see anything that says the pistol guy has been charged with 1st degree attempted intentional murder. And come to think of it, That first guy Kyle shot, the pediphile who had thrown some kind of plastic wrapped brick at him and then tried to grab the rifle, he isn't the one that shot at Kyle just before that. We still don't know who that was, and he too should be charged with attempted murder.

Personally, I think if the prosecutor fails to charge pistol guy, he should himself be charged as an accessory after the fact to attempted first degree murder.

One man was wearing a metal helmet with goggles and military-style gear with multiple pouches, and was carrying an Antifa flag. When the officer pulled his squad car in front of the group, they ran away. The officer caught Banta, who was carrying the flag, and says Banta “dropped into the fetal position and began crying.”

He has pretty much a "dream team" for legal representation, paid for by various gun rights organisations. I think he may be OK in the long term.

Kyle made some poor decisions, but many many 17 yr olds have made far worse ones; and his decisions were made while attempting to do good.
