I don't think a lawsuit would be needed.

I think that qualifies as justifiable homicide. Perhaps even after waiting for the cool off period on a new .454 Casull.

UPDATE:

The surgical nurse admits to saying to the doctor, "Slap me some skin."
And may I say, from a moral point of view, I think there can be no justification for shoving snack cakes up your action.
