That's happened...but the ultimate authority rests with the men with the guns. If the Fleet says we're upholding the Second Amendment, the politicians and lawyers don't count for much.

Remember that pretty much all politicos are cowards. They always look for the safest and easiest road when making decisions. The last thing they would ever want is a hard core constitutional slugfest in which the possibility of the military would have to step up to defend their oath to the Constitution.
And they know that an outright gun ban would be very, very unpopular- to the point that many would lose seats in two years. And the number one idea that every politian holds to, left or right, is a devotion to re-election.

So, instead of ordering the supremes to vacate Heller, look more for smaller bites- mag cap limits, cosmetic feature bans, onerous import restrictions, until they can get enough lefties on the court to allow for bigger restrictions.

Just FYI, all Reconstruction era cases have been "reduced to their facts" by SCOTUS, they have no precedential value, and are considered shameful deeds, not to be mentioned.

Frankly, Scalia was a hair's breadth from doing the same to Miller, but that would have required actual legal reasoning/at least reading the cases, from the 4 idiots.

Congress could, probably, manage to pass an amendment limiting SCOTUS, but... well, it wouldn't be popular politically, and I can't see 3/4s of the state's possibly ratifying it...

Concur as to the realities of legal opinions vs force of arms.
Also Concur as to the general lack of intestinal fortitude of most politicians.

So would that lead to general insurrection? or has too much of this country lost the will to oppose that which is wrong?

When I think of hazarding my wife and children, I must pause.......

The FF viewed Duty and Honor above their families -- they also weren't fighting a complete monster, who would have, openly, retaliated against their wives and children -- Socialists, traditionally, don't have such scruples.

I have neither a wife, nor children, so my opinion is, perhaps, invalid, but I think it comes down to whether you're willing to have your children continue to live/survive in such a system...

(I know a disturbing number of Christians who are unsure about birthing children into slavery... Collapsing birthrates, in an age of birth control, has been a real bane of oppressive regimes...)
