The use of the word "but" usually indicates that everything preceding it in a sentence is a lie.
E.g.:

It will get reversed en banc just like Peruta did. But maybe now we have a shot at getting it before SCOTUS. Given that Hawaii is said to be effectively no-issue, it's probably a good case for that.

Appears to be the same lead judge as in Peruta. Perhaps we can have him replace RBG once the actuarial tables catch up with her. Be amusing, if only to watch the talking heads have to try & pronounce his name...

My analysis is the same. This case was written by the same judge who wrote Peruta.
